My drivers license is from a different state.
The Non-Resident Violator Compact (NRVC) allows other states to recognize the DMV actions of Colorado. That means that, even if you were stopped in Colorado, your home-state license may also be suspended and subject to the same reinstatement requirements as Colorado.
What happens if my license is revoked and I also plead guilty to a DUI/DWAI in court?
If your license is revoked through the DMV for a refusal or excess BAC, a subsequent conviction in the courts will not trigger a second revocation of your license. However, the courts may impose additional requirements unrelated to your license.
Can I get a probationary license?
No, as those are largely reserved for suspensions that are not triggered by Express Consent (DUI/DWAI tickets). However, you can reinstate your license which will allow you to drive anywhere at any time.
What is the DMV Hearing?
The DMV hearing is for a DMV Hearing Officer to determine whether police had reasonable suspicion to initiate the stop, reasonable suspicion to invoke Express Consent, and whether they followed the rules for advising and testing you. At the end of the hearing, the DMV Hearing Officer will determine whether to uphold the revocation or dismiss the action. In many cases, the drivers license implications far exceed the penalties the courts impose, and this is your time to fight to retain your license. What’s the difference between a suspension, revocation, cancellation, and/or denial of my driving privilege?
Revocation: A mandatory restraint action on a valid driver license or driving privilege. A revoked license is invalid and cannot be re-issued. After reinstatement of your driving privilege you must re-test (both written and drive) to be issued a new license.
Suspension: A temporary withdrawal of the driving privilege. A suspension is a restraint action but does not void the driver license. A valid license may be re-issued upon reinstatement. A license that has expired, must be renewed upon reinstatement. Point suspensions require a written test at renewal.
Denial: A restraint action when no valid license exists at the time of restraint. Cancellation/Denial: Actions to void a Colorado license and deny the driving privilege. Reinstatement is required and passing of a written and a road test is mandatory.
Cancellation: This action will void a valid Colorado license. A cancellation, by itself, is not a restraint action and does NOT require reinstatement if complied with in a timely manner. Another license/permit may be issued, unless the reason for cancellation is still outstanding.
What is SR-22 insurance?
SR-22 is a rider to an insurance policy that notifies the DMV if your insurance is no longer active. If your insurance policy is not active, the DMV will be immediately notified and suspend your license for that reason alone.
Do I need an interlock device?
1st Conviction for Excess BAC or DUI:
BAC (.05-.149): You will need to have interlock for 9 months but can get it removed after 4 months if you’re successful.
BAC .15 or above: You will need interlock for 2 years.
2nd Conviction for Excess BAC or DUI: You will need to have interlock for 2 years.
Refusal of Blood or Breath Test: You will need to have interlock for 2 years.
